Terms of Service

Welcome to Sustain ("we," "our," or "us"). By downloading, installing, or using the Sustain mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Description of Service

Sustain is a home inventory and warranty tracking application that helps users manage their warranties, track home inventory, receive product recall alerts, and access AI-powered features for product identification and maintenance planning.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements.

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Free and Premium Services

Sustain offers both free and premium features:

• Free Features: Unlimited item tracking, warranty expiration notifications, product recall alerts (CPSC), barcode scanning, manual entry, home profile setup, localization settings, referral program, and budget planning.
• Premium Features: AI-powered photo identification, product page scanning, receipt scanning, AI-assisted entry, product URL lookup, AI claim assistant chat, PDF export for insurance, and AI-generated maintenance plans. Premium is available at $4.99/month or $35.99/year.

5. Subscriptions and Payments

Premium subscriptions are processed through Google Play or the Apple App Store. By purchasing a subscription, you agree to the following:

• Payment is charged to your Google Play or Apple account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription through your device's app store settings
• Refunds are subject to the policies of Google Play or the Apple App Store
• We reserve the right to change subscription pricing with reasonable notice

6. AI-Powered Features

Sustain uses artificial intelligence (powered by Anthropic's Claude) to provide features such as product identification, warranty lookup, maintenance planning, and claim assistance. You acknowledge that:

• AI-generated information is provided as a helpful reference and may not always be 100% accurate
• Warranty information retrieved by AI should be verified with the manufacturer
• AI features search the web for real-time information, but results depend on available online data
• AI-generated content does not constitute legal, financial, or professional advice
• You should independently verify any critical information before making decisions

7. Product Recall Alerts

Sustain checks your tracked items against the U.S. Consumer Product Safety Commission (CPSC) recall database. You acknowledge that:

• Recall matching is based on product name similarity and may produce false positives or miss matches
• Sustain does not guarantee identification of all applicable recalls
• You should independently verify recall information at cpsc.gov
• Recall alerts are provided as a convenience and do not replace official manufacturer notifications

8. User Content and Data

You retain ownership of all data you input into the App, including product information, photos, receipts, and notes. By using the App, you grant us a limited license to store, process, and display your data solely for the purpose of providing the service to you.

• You are responsible for the accuracy of data you enter
• You may export your data at any time using the PDF export feature
• You may delete your account and associated data at any time through the App's Settings
• Photos and images you upload are stored securely in our cloud storage

9. Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Use automated methods to access the App (bots, scrapers, etc.)
• Abuse the AI features by submitting excessive or malicious requests
• Impersonate another person or misrepresent your affiliation
• Use the referral system fraudulently

10. Intellectual Property

The App, including its design, features, code, and content (excluding user-submitted data), is owned by Sustain and protected by intellectual property laws. The Sustain name, logo, and branding are our trademarks. You may not use our intellectual property without prior written consent.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The App will be uninterrupted, error-free, or secure
• AI-generated warranty information will be accurate or complete
• Product recall alerts will identify all applicable recalls
• The App will meet all of your requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUSTAIN AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Sustain, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

14. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by deleting your account through the App's Settings. Upon termination, your right to use the App ceases immediately.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions.

17. Referral Program

Sustain offers a referral program where both the referrer and the referred user may receive one month of free Premium access. We reserve the right to modify, suspend, or terminate the referral program at any time. Abuse of the referral system, including creating multiple accounts, may result in account termination.

18. Third-Party Services

The App integrates with third-party services including:

• Anthropic (Claude AI): Powers AI features. Subject to Anthropic's policies.
• CPSC: Product recall data from the U.S. Consumer Product Safety Commission.
• Google Play / Apple App Store: Subscription billing and app distribution.
• Supabase: Backend infrastructure and data storage.
• RevenueCat: Subscription management.

We are not responsible for the availability, accuracy, or practices of these third-party services.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sustain regarding the use of the App.
